The paper traces the opposing trends through corporate human rights cases and suggests that the answer may lie in attitudes towards national sovereignty.
Ms. Jodie Kirshner is University Lecturer in Corporate Law and Deputy Director of the Cambridge Centre for Corporate and Commercial Law.
Dr. Markus Gehring is Tutor in Sustainable Development Law and Deputy Director of the Centre for European Legal Studies
