Cambridge Private Law Centre Discussion: 'Recent Developments in Tort Law'

Time & location: 5:30-6:30pm in the Moot Court Room.

Jonathan Morgan will lead the discussion, which will focus on two recent decisions about the scope of vicarious liability for deliberate wrongdoing. JGE v. Trustees of the Portsmouth Roman Catholic Diocesan Trust [2012] EWCA Civ 938 is particularly noteworthy, perhaps, for the full exploration of the policies behind vicarious liability (and whether these justify a broad notion of who counts as an "employee" for these purposes) by Ward LJ. Even more recently the Supreme Court has examined this issue (as well as the more familiar question of whether abuse was within the "course of employment") in "Various Claimants" v. Institute of the Brothers of the Christian Schools [2012] UKSC 56.
