This talk will explore the challenges of assembling a novel dataset about the personal characteristics of the 540 ICSID (International Centre for Settlement of Investment Disputes) arbitrators who have been appointed to adjudicate the more than 500 arbitration cases before ICSID. This dataset will be used in a quantitative empirical analysis of how arbitrators’ backgrounds influence outcomes in investment treaty arbitrations. Both investors and host states expend considerable resources to influence the arbitration outcomes through arbitral appointments, raising an important question: is an arbitrator’s decision biased toward his or her appointing party?
