Title: "Putting Opinion 1/17 in Context: ISDS Reforms"

Abstract: On April 30, 2019 the Court of Justice of the EU rendered its Opinion in Case C-1/17 on the compatibility of the investment court system (ICS) provided in the EU-Canada Comprehensive and Economic Trade Agreement (CETA) with EU law. Opinion 1/17 comes almost a year after the Court’s landmark judgement in Achmea and forms another piece of the puzzle of the complex relationship of the CJEU with judicial competitors and international arbitration. The presentation will discuss where this judgment fits into the broader debate on the backlash against investor-State arbitration and the proposals for reform, including primarily on the establishment of an investment court (bilateral or multilateral – MIC).
