The Limits of the Absolute: Delimiting the Scope of Article 3 of the European Convention on Human Rights

Summary

My research aim is to explore the concept of an absolute right and the limits of the absolute right embodied in Article 3 of the European Convention on Human Rights (ECHR), which prohibits torture and inhuman or degrading treatment or punishment, with a view to arriving at a coherent interpretation of its scope by focusing on two key aspects: (1) the definition of the proscribed treatment and (2) the range of State action necessitated by the correlative duty. In doing so I will look both at legal philosophy and at European Court of Human Rights (ECtHR) case law, using comparative perspectives to assist in my analysis of the underlying values.
