Title: 'Law, Policy, Expertise: Judicial Review in EU Competition Law'

Speaker: Professor Pablo Ibáñez Colomo, LSE  

Biography: 

Pablo Ibáñez Colomo is Professor of Law and Jean Monnet Chair in Competition and Regulation at London School of Economics and Political Science. He is also a Visiting Professor at the College of Europe (Bruges), Joint General Editor of the Journal of European Competition Law & Practice and co-editor of the Chillin’ Competition Blog. He received a PhD from the European University Institute in June 2010 (Jacques Lassier Prize). Before joining the EUI as a Researcher in 2007, he taught for three years at the Law Department of the College of Europe (Bruges), where he also completed an LLM in 2004.

Abstract: 

The interpretation of EU competition law provisions by the European Commission is subject to full review by the EU courts. Strict judicial scrutiny does not extend, however, to the policy choices made by the administrative authority. The latter are only controlled, if at all, for manifest errors of assessment. Drawing the line between issues of law and policy, however, is not a straightforward exercise in practice. For the same reason, it may not be easy to ensure that the legal interpretation of competition law provisions is subject to full review: annulling a decision necessarily has an impact on the effectiveness of policy. This paper considers how the EU courts have engaged with these matters. It also considers the role of expert knowledge, with which they occasionally have to engage in order to interpret the law.
