Speaker: Justice Abhay S Oka (Former Judge, Supreme Court of India)

Dr Lovleen Bhullar (Assistant Professor of Environmental Law, Department of Land Economy) will moderate the discussion.

Justice Oka has played a pivotal role in shaping environmental jurisprudence in India, advancing an increasingly active role for the judiciary in environmental protection. He spearheaded the Court’s efforts during the Delhi air pollution crisis, addressing key drivers of urban pollution including vehicular emissions, deforestation, and banning of firecrackers. Through his judgments, he has reinforced environmental protection as an integral component of constitutional rights, recognising the right to a pollution-free environment and emphasising the State’s duty in safeguarding the ecology. His jurisprudence reflects a commitment to prioritising pressing environmental concerns, while foregrounding environmental protection within the broader framework of social justice. The discussion will explore wider questions at the intersection of environmental protection and public law, including the judiciary’s evolving role in addressing contemporary environmental challenges.
