Abstract

On what grounds do courts award remedies? I argue that one such ground— arguably the most fundamental—is proof of a rights-threat. In my presentation, I explain the meaning of 'rights-threat', discuss why courts award remedies in response to rights-threats, and identify the main private law 'rights-threatresponding remedies'. The latter include injunctions, specific performance, orders to pay a debt, orders for the recovery of land or chattels, and—a special focus of my presentation—some (but only some) damages awards.

This seminar is open to all LLM, MCL and PhD students, Faculty members and Faculty visitors.

*The Wolfson Seminar Room (South) at Trinity College is located in Whewell’s Court (the other side of Trinity Street from Trinity’s Great Gate). Go half way down Whewell’s Court, then into the Wolfson Building (on the right when entering Whewell’s Court from Trinity Street); the seminar rooms are on the 3rd floor.
