David Greene (Vice-President of the Law Society of England and Wales) addresses the legal and constitutional issues arising from in the case of R (on the application of Miller) v. The Prime Minister [2019]. What is “the Rule of Law”? And should it be subject to “the will of the people”? Is our unwritten constitution and its conventions still fit for purpose? Should the Courts operate a supervisory jurisdiction over the executive? And what is their mandate for doing so on “political” issues”? Is the prorogation of Parliament a political or constitutional issue? These are some of the important issues with which David will grapple. We look forward to a lively Q&A session!

Having acted for the second claimant in the Article 50 litigation R (on the application of Miller and Dos Santos) v. Secretary of State for Exiting the EU [2016], David is one of the most-informed lawyers on the Brexit process and its constitutional and legal ramifications. Amongst other things, he is Chair of the Law Society’s International Committee and Chair of the Brexit Task Force and has written and lectured in the UK and Europe on Brexit-related issues.
