The payment provider Wirecard was once a member of the German blue chip-index and for many a German tech-hope. Rumors and reports in the Financial Times resulted not in investigations discovering the now apparent wrongdoings. Neither Wirecard’s supervisory board nor the German supervisory agency detected fraud committed by members of the management board. In Germany, the government introduced the Financial Stability Enhancement Act, but European legislation might follow.

Markus Roth is Professor for Civil Law, Labour Law, German and European Commercial and Business Law at the University of Marburg since 2009. From 2002 to 2008 he was Senior Research Fellow at the Max Planck Institute for Comparative and International Private Law in Hamburg. He has published widely on German and European corporate, labour, pension and financial law, for example a 2000 pp. annotation on the German supervisory board (Großkommentar Aktiengesetz, 2019, with Klaus J. Hopt, in German).
