Abstract: Administrative policies are central to modern public decision-making, to such an extent that some scholars refer to them as ‘internal administrative law’. But such policies may be subject to judicial review: an interaction between internal and external controls on decision-making. Policies may also affect the contours of judicial review claims against specific decisions. This paper considers the relationship between these policies and the law, and especially whether there can be a sensible classification of judicial review challenges to policies, with reference to the purpose of policies and the purpose of administrative law.
