On the Application of Article 102 TFEU in the Pharmaceutical Sector
Summary
This research will investigate how the EU abuse of dominance prohibition contained in Article 102 of the Treaty on the Functioning of the European Union (TFEU) can and should be applied in pharmaceutical markets. It will analyse in particular the unique legal framework applicable to pharmaceutical markets, assess factors facilitating dominance in those markets, and investigate the types of 'abuses' of dominant positions that may occur in pharmaceuticals.
